An uncontested divorce means the two of you have already agreed on everything the judgment has to decide.

How to divide your property

3. Children

Do you and your spouse have children together who are under 18?
Is either of you currently pregnant?

4. Safety

Is there a restraining order between you and your spouse, now or in the past?
Is there any concern about domestic violence, threats or abuse in your relationship?

5. Other facts the court cares about

Does either of you have a bankruptcy case pending?
Is your spouse on active military duty?
Do you know where your spouse lives, so that papers can be handed to them?
Does either of you own a business or a professional practice?
Does either of you have a pension or retirement plan that must be divided by a court order (a qualified domestic relations order)?
A 401(k) or IRA that one of you simply keeps does not need one. A plan that will be split between you usually does.
Does either of you own real property outside California?
Are both of you comfortable reading and signing legal documents in English?

6. Where you live

California requires that at least one of you has lived in California for six months and in the county where the case is filed for three months.

7. Your marriage and what you own

These answers decide whether you qualify for the simpler summary dissolution (a marriage of 5 years or less, community property under $57,000, separate property under $57,000 each, community debts under $7,000, cars not counted) or for the regular uncontested divorce. Does either of you own or have an interest in real property (a house, a condo, land), other than a lease of a year or less with no option to buy?
Would both of you sign a joint petition together, if you qualify for the summary process?

8. Court fees
